ANRAD, Price Chopper Shopping Center, 489 Pittsfield Rd., Map 33 Parcel 4. Continued from October 16, 2008. Present was Anne McMenemy, Tim Williams and Jeff Heidelberg of Environmental Resources Management.

Ms. McMenemy addressed all items of concern that had been expressed by the Commissioners at the previous meeting.  After some discussion she reviewed the comments which had been made by the Department of Environmental Protection when issuing the File Number.  It was agreed that the ANRAD is only delineation and that the Notice of Intent, which is expected to be filed in time for the first meeting in December will have more detail.

In regards to the fire pond, the DEP estimated it to be approximately 10,200 square feet.  This estimation was made from aerial photos.  ERM said that they surveyed the pond and determined that the square footage was 8,957 square feet.  Ms. Menemy said that they met with Fire Chief Danny Clifford today to discuss storage analysis.

A site visit had taken place with various agencies with regard to the MEPA review on November 5, 2008.  A Regional Planning Commission Clearinghouse Review Report Draft of November 6, 2008 by Lauren Gaherty was made available to the Commissioners for their review.  

The Commissioners will meet November 8, 2008 at 8:30 am to look at the existing fire pond.

RFC made a motion to accept the delineation shown on the revised plan dated October 22, 2008.  VA seconded the motion and the Commission agreed to approve 6-0.


Notice of Intent, Richard Heiss, Sargent Brook Road, Map 1 Lot 2 of Parcel 35.  Continue to mow an existing 6’ wide grass path through the buffer zone and BVW to Laurel Lake; mow a 12’ by 12’ sitting area; install a boat rack, 2 pipes for attachment of removable floating dock, weed-whack parcel two times a year and remove invasive shrubs. Continued from August 21, 2008, September 4, 2008, September 18, 2008, October 2, 2008.  JS made a motion to continue to December 18, 2008 and RFC seconded the motion.  The Commission voted to agree 6-0.

Notice of Intent, Mass Highway 270 Main St., Map 17 Parcel 57.  Capping of an inactive solid waste disposal area. Continued from August 7, August 21, 2008, September 4, 2008, September 18, 2008. (Originally on the April 17, 2008 agenda.) Continued from October 2, 2008. VA made a motion to continue to December 18, 2008 and TF seconded the motion.  The Commission voted to agree 6-0.

David Case, Lenox Gateway, LLC, discuss extension of Order of Conditions, 55 Pittsfield Road:  Bob Fournier of SK Design requested an extension of the Order of Conditions which was issued almost 3 years ago as additional work remains to be done.  A “punch list” had been prepared.  Citing tightening financial constraints, Mr. Fournier asked the Commission if an extension could be granted even if all items were not completed.

The Commission stated that re-flagging and the re-installation of the silt fence, both which should have been maintained all along, must be done before the Commission could consider an extension.  When winter sets in it will not be possible to meet these requirements.  Without an extension, Mr. Case would have to file and start the process anew which would be far more expensive for the applicant.

The Commission agreed to meet again on November 20, 2008 at 7:45 pm to follow up on the work required.

Toole Properties 2001:  RDA filed for improved drainage off of Mollie Way at The Yankee, Hampton Inn and the Professional Building.  A site visit has been scheduled for November 17, 2008 at 4:00 pm.

Minutes of October 16, 2008:  RFC made a motion to approve the minutes and DL seconded the motion.  The Commission voted to approve 6-0.

Post Farm access at East Street:  NC noted that access is now being blocked by a trailer in addition to the logs.  This is a continuing problem and the Commission has asked that PA notify the Town Manager again.

Conservation Commission Funds:  PA was asked to inquire of the Town Manager if approximately $2500.00 could be appropriated for construction of two gates for Post Farm.  

Woods Pond:  PA advised that Cris Roberts of the Assessor’s Office has not been able to determine the ownership of the property at Woods Pond where people launch their canoes.  Charlie Liston has offered to look through records in the Assessor’s Office to see if he can determine.

RFC made a motion to adjourn the meeting and DL seconded the motion.  The Commission voted to adjourn at 9:15 pm.
